1. INTRODUCTION
The Board of Directors of AuMAS wishes to announce the following developments in the ongoing legal proceedings involving its wholly-owned subsidiary, Wullersdorf Resources Sdn. Bhd. ("WRSB"), and Southsea Gold Sdn. Bhd. ("SGSB"):
(a) on 14 August 2026, WRSB and the Company obtained a further ex-parte injunction ("3rd Injunction") against, amongst others, SGSB in High Court of Sabah and Sarawak at Tawau Suit No. TWU-22NCvC-5-2/2024, consolidated with Suit No. TWU-22NCvC-12-7/2023 ("Consolidated Suits"); and
(b) on the same date, SGSB separately obtained an ex-parte interim prohibitory injunction against WRSB in High Court of Sabah and Sarawak at Tawau Suit No. TWU-22NCvC-21-7/2026 ("Suit 21"), which WRSB has on 17 August 2026 applied to set aside.
2. 3RD INJUNCTION OBTAINED BY THE COMPANY AND WRSB
Reference is made to the Company's previous announcements concerning the Consolidated Suits, including the interim injunction granted on 4 December 2023 ("1st Injunction"), which restrains SGSB and the other relevant defendants from hindering WRSB's mining operations, and the further injunction granted on 6 November 2025 ("2nd Injunction") in relation to rectification and/or modification works to the perimeter drainage serving WRSB's Tailings Storage Facility ("TSF").
Following the earlier incidents, WRSB constructed a Water Treatment Pond as part of the water-management and containment measures serving the TSF. The Water Treatment Pond is reflected in the Operational Mining Scheme ("OMS") approved by the Department of Minerals and Geosciences Malaysia, Sabah ("JMG") for the period from 9 April 2026 to 9 April 2027 and falls within the area covered by the approved Environmental Impact Assessment ("EIA").
On 11 and 12 August 2026, SGSB and/or persons acting on its behalf carried out earthworks using heavy machinery in the area surrounding the Water Treatment Pond, resulting in the covering, filling-in and/or destruction of the Water Treatment Pond. WRSB has lodged police reports in relation to these incidents.
In view of the need to restore the Water Treatment Pond and to ensure WRSB's continued compliance with the approved EIA and OMS, the Company and WRSB applied on 13 August 2026 for the 3rd Injunction.
On 14 August 2026, the Court granted the 3rd Injunction substantially in the terms sought, restraining SGSB and the relevant defendant from, amongst others, hindering the necessary restoration and/or modification works to the Water Treatment Pond and related containment facilities, entering the demarcated area in which those facilities are situated, and carrying out works within the area covered by WRSB's approved EIA and OMS without leave of Court.
The inter-partes hearing of the 3rd Injunction has been fixed for 28 August 2026.
3. INJUNCTION OBTAINED BY SGSB AND WRSB'S SETTING-ASIDE APPLICATION
On 14 August 2026, the Court also granted SGSB an ex-parte interim prohibitory injunction against WRSB in the separate Suit 21 arising from allegations of leakage and seepage from the TSF.
The injunction temporarily restricts WRSB from carrying out activities that would introduce further material into, or otherwise increase the hydraulic, geotechnical or environmental load of, the TSF.
The injunction expressly does not prevent WRSB from carrying out inspection, emergency containment, sampling, monitoring, pumping, treatment, neutralisation, repair or remediation works which do not add to the TSF's load, subject to the conditions stipulated by the Court.
The Court further expressly ordered that nothing in the injunction changes, suspends or permits a breach of the earlier Court orders, including the order dated 4 December 2023, and that SGSB must not interfere with WRSB's access or genuine inspection, containment, repair or remediation works protected by those earlier orders.
The injunction is temporary and remains in force only until the earliest of the inter-partes hearing, a further order of Court, the injunction being revoked or set aside, or its automatic expiry 21 days after it was granted pursuant to Order 29 rule 1(2B) of the Rules of Court 2012. The inter-partes hearing is presently fixed for 28 August 2026.
On 17 August 2026, WRSB filed an application to set aside the ex-parte injunction obtained by SGSB.
The application is based on, amongst others, the following grounds:
(a) material non-disclosure, including the alleged failure by SGSB to disclose material regulatory and technical developments concerning the TSF, including inspections conducted by the relevant authorities in July 2026 following which no stop-work order or directive requiring WRSB to cease operations was issued;
(b) the circumstances surrounding SGSB's application for the ex-parte injunction, including WRSB's contention that material matters arising from the ongoing litigation between the parties and the events concerning the Water Treatment Pond were not adequately brought to the attention of the Court;
(c) inconsistency with the existing injunction orders, including WRSB's contention that the restrictions imposed by SGSB's injunction conflict with and/or infringe upon WRSB's rights protected under the earlier injunction orders dated 4 December 2023 and 6 November 2025 relating to WRSB's operations, use of its facilities and rectification works concerning the TSF; and
(d) overlap with existing proceedings, including WRSB's contention that Suit 21 and the injunction obtained therein overlap with matters raised in Suit No. TWU-22NCvC-30-10/2025 ("Suit 30"), which was stayed by the Court on 30 July 2026.
WRSB is accordingly seeking, amongst others, an order that the ex-parte injunction obtained by SGSB on 14 August 2026 be set aside. The application will be determined by the Court in due course.
4. FINANCIAL AND OPERATIONAL IMPACT
The 3rd Injunction and the ex-parte injunction obtained by SGSB are not presently expected to have any material operational impact on the Group, including WRSB's ongoing mining and processing operations.
Accordingly, the above developments are not presently expected to have any material financial impact on the Group, including on its earnings, net assets or gearing for the financial year ending 30 September 2026.

The Company will make further announcements on any material developments in relation to these matters as and when appropriate.
